Below is a very brief description
of the Regulatory Reform (Fire Safety) Order 2005 and how it affects all
businesses when persons are employed.
THE REGULATORY REFORM
( FIRE SAFETY ) ORDER 2005
- The Fire Safety Order applies
to all buildings excluding Domestic premises occupied as a single private
dwelling.
Responsibility for complying
with the order rests with the Responsible Person in the workplace who:-
- shall
take such General Fire Precautions and will ensure so far as is reasonably
practicable the fire safety of any of his employees
and
- In
relation to the Relevant persons who are not his employees take such
General fire precautions as may be reasonably required in the circumstances
to ensure a premises is safe
Risk assessments must be reviewed
by the responsible person regularly to keep it up to date and particularly
if
- There
is reason to suspect it is no longer valid
- There
has been significant changes to which the risk assessment relates including
when the premises special, technical and organisational measures or
organisation of work under go significant change, extension or conversion
The responsible person must
not employ a young person unless he has made or reviewed an assessment
in relation to the risks to the young persons. When making or reviewing
the assessment the responsible person who employs or is to employ a young
person must take account of:-
- The
inexperience, lack of awareness of risks and immaturity of young persons
- Layout
of the premises
- The
nature, degree and duration of exposure to physical and chemical agents
- The
form, range and use of work equipment and the way it is handled
- The
organisation of processes and activities
- The
extent of safety training provided or to be provided to young persons
and
- Risks
from agents, processes and work listed in council directive 94/33/EC(a)
‘Young person’ means any person
who has not attained the age of 18
As soon after, as practicable,
that a risk assessment has been made the responsible person must record
the information where:-
- He
employs five or more persons
- A
licence under other enactments is in force
- An
Alterations notice requiring this is in force
The
prescribed information to be recorded is
- The
significant findings of the assessment including measures which have
or will be taken by a responsible person to comply with this order
- Any
group of persons identified by the assessment as being at risk
No
new work activity involving dangerous substances may commence unless
- A
risk assessment has been made and
- The
measures required by this order have been implemented
Elimination
or reduction of risk from dangerous substances
- Where
a dangerous substance is present in or on a premises the responsible
person must ensure the risk to relevant persons is eliminated or reduced
so far as reasonably practicable
- Dangerous
substances, must be so far as reasonably practicable, be replaced or
the risk from its use reduced Next
